Faulty brake lights

On my way to work this morning, I had this car in front of me with one brake light working.

Sometimes I cldnt tell whether or not he had stopped or was still moving . "We were in traffic by the way ", so I thought to myself, Roadsafety guys are right when they catch people with bad brake lights because this could cause an accident.

Imagine this scenario , a road safety officer catches a driver with bad brake lights and calls on you to decide whether or not to let him go, what would be your verdict?
